The Court Just Said It: Clean Water Is Not Your Constitutional Right

A federal appeals court ruled last week that the U.S. Constitution does not guarantee you the right to clean drinking water.
Let that sit for a second.
The full U.S. Court of Appeals for the Fifth Circuit ruled 10-5 that the 14th Amendment does not protect Americans from exposure to contaminated municipal water. The case came out of Jackson, Mississippi, where residents sued the city after testing showed elevated lead levels in the water supply going back to 2010. They argued the city knew and said nothing. The court's response, essentially, was that this is a tragedy but not a constitutional violation.
"The Constitution does not provide redress for every governmental wrongdoing," wrote Circuit Judge Kurt Engelhardt. The ruling also made clear there is no constitutional right to accurate information from public officials during a public health crisis.

Cities and municipalities can mismanage their water systems, allow contamination to persist, and fail to tell residents the truth, and residents may have little or no constitutional recourse. The Jackson case is a sharp illustration of how those gaps play out in real life. Four residents filed suit in 2022 after state health department data from nearly a decade earlier showed lead in the water. A decade. And the legal outcome was still dismissal.
